By engaging OMNIMAX LLC for construction, roofing, or related services, you agree to be bound by these Terms of Service. Please read them carefully and contact us if you have any questions before proceeding with our services.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "Client," or "you") and OMNIMAX LLC ("Company," "we," "us," or "our"). By requesting a quote, scheduling a consultation, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree with any part of these Terms, please do not use our services. These Terms apply to all construction, roofing, remodeling, restoration, and related services provided by OMNIMAX LLC.
2. Services Provided
OMNIMAX LLC provides the following services in Nevada:
- Residential and commercial roofing installation, repair, and replacement
- General construction and remodeling services
- Kitchen and bathroom renovations
- Fire and water damage restoration
- Insurance claim assistance and consultation
- Emergency repair services
- Property inspections and assessments
All services are subject to availability, licensing requirements, and applicable local regulations. We reserve the right to decline any project that falls outside our expertise or licensing scope.
3. Estimates and Contracts
Free Estimates
We provide free estimates for most services. Estimates are based on visual inspection and information provided by the customer. Final pricing may vary based on actual conditions discovered during work.
Written Contracts
All work exceeding $500 will be governed by a written contract that includes:
- Detailed scope of work and materials specifications
- Project timeline and completion dates
- Total cost breakdown and payment schedule
- Warranty terms and conditions
- Change order procedures
4. Payment Terms
Payment Schedule
- Deposit: A deposit may be required before work begins, not to exceed 10% of the total contract value or $1,000, whichever is less
- Progress Payments: Payments are due based on work completion milestones as outlined in the contract
- Final Payment: Due upon satisfactory completion of all work and customer approval
- Emergency Services: Payment due within 30 days of service completion
Accepted Payment Methods
We accept cash, checks, credit cards, and bank transfers. A convenience fee may apply to credit card transactions. Late payments may incur interest charges as permitted by Nevada law.
5. Warranties and Guarantees
Workmanship Warranty
OMNIMAX LLC provides a comprehensive workmanship warranty on all completed projects:
- Roofing Work: 5-year warranty on workmanship, material warranties as per manufacturer
- Construction/Remodeling: 2-year warranty on workmanship
- Repairs: 1-year warranty on repair work
- Emergency Services: 90-day warranty on emergency repairs
Warranty Limitations
Warranties do not cover damage caused by acts of nature, normal wear and tear, improper maintenance, or modifications made by others. Warranty claims must be reported in writing within 30 days of discovery.
6. Insurance and Liability
Our Insurance Coverage
OMNIMAX LLC maintains comprehensive insurance coverage including:
- General liability insurance ($2,000,000 per occurrence)
- Workers' compensation insurance
- Professional liability insurance
- Bonding as required by law
Limitation of Liability
Our liability is limited to the contract value of the specific work performed. We are not liable for indirect, consequential, or punitive damages. Customer is responsible for protecting personal property and ensuring adequate homeowner's insurance coverage.
7. Customer Responsibilities
To ensure successful project completion, customers agree to:
- Provide accurate information about property conditions and requirements
- Obtain necessary permits (unless specified in contract that we will obtain them)
- Ensure safe access to work areas
- Remove or protect personal property in work areas
- Provide utilities (water, electricity) as needed for work completion
- Make timely payments according to the agreed schedule
- Communicate any concerns or changes promptly
8. Cancellation and Changes
Customer Cancellation Rights
Customers may cancel contracts within 3 business days of signing (Nevada's "cooling-off" period) for a full refund of any deposits paid. After this period, cancellation terms are as follows:
- Before work begins: Refund of deposit minus administrative costs (maximum $200)
- After work begins: Payment due for work completed plus materials ordered
- Emergency services: No cancellation once work has commenced
Change Orders
Any changes to the original scope of work must be documented in writing and signed by both parties. Additional costs and time extensions will be clearly outlined before proceeding with changes.
9. Dispute Resolution
Informal Resolution
We encourage customers to contact us directly to resolve any concerns. Most issues can be resolved through open communication and good faith efforts.
Formal Dispute Resolution
If informal resolution is unsuccessful, disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Clark County, Nevada, and Nevada law will govern the proceedings.
10. Force Majeure
OMNIMAX LLC is not liable for delays or inability to perform due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, government regulations, labor disputes, material shortages, or public health emergencies. We will make reasonable efforts to minimize delays and communicate with customers about revised timelines.
11. Governing Law
These Terms are governed by the laws of the State of Nevada and applicable federal laws. Any legal proceedings must be brought in the appropriate courts of Clark County, Nevada. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
12. Modifications to Terms
OMNIMAX LLC reserves the right to modify these Terms at any time. Updated Terms will be posted on our website with a new effective date. Existing contracts will remain governed by the Terms in effect at the time of contract signing. Continued use of our services after Terms modifications constitutes acceptance of the updated Terms.
